1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of Luv Mediation, including the iOS app, website pages, booking tools, Google Meet sessions, support inbox, discount-code features, surveys, reviews, owner resolutions, and related services (collectively, the "Service"). By creating an account, booking a session, joining a session, sending a message, submitting a survey, approving recording, or otherwise using the Service, you agree to these Terms and the Luv Mediation Privacy Policy.

If you do not agree, do not use the Service.

2. Service Description

Luv Mediation provides direct, experience-based relationship guidance from Joseph Souffrant. The Service is designed for people who want practical perspective, conflict discussion, and a clear recommendation or next step. Luv Mediation currently offers Personal Clarity and Two-Person Resolution sessions.

Joseph may provide a written resolution, reasoning, and action steps after a session. The written resolution represents Joseph's practical recommendation based on information shared during the session. It is not a court order, legal ruling, therapy diagnosis, medical recommendation, or guaranteed outcome.

3. Not Therapy, Legal Advice, Court Mediation, Medical Care, or Emergency Support

Joseph Souffrant is not acting as a licensed therapist, psychologist, psychiatrist, attorney, court-certified mediator, medical professional, emergency responder, or crisis counselor. The Service is not a substitute for professional therapy, legal representation, medical care, domestic-violence support, emergency services, or crisis intervention.

If you are in danger, experiencing abuse, facing a mental-health crisis, or need urgent help, contact local emergency services, 988 in the United States for mental-health crisis support, a qualified professional, or a local crisis resource immediately. Do not rely on Luv Mediation for emergency or crisis response.

4. Eligibility and Account Requirements

You must be at least 18 years old to use Luv Mediation. You agree to provide accurate first name, last name, email address, verified mobile phone number, and other requested account information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Phone verification is required for new client accounts. You agree not to create false accounts, impersonate another person, use another person's phone number without permission, or interfere with the Service.

5. Sessions, Prices, and Payment Methods

The current session price is $39.99 for a 45-minute session unless a valid discount code applies or a different price is displayed at checkout. Personal Clarity sessions use Stripe payment processing where available. Two-Person Resolution sessions on iOS use Apple in-app purchase where required by App Store rules.

Payments are due before a session is confirmed. A session is not guaranteed until payment, Apple in-app purchase, or an approved free-session code is successfully processed and the app confirms the booking.

6. Discount Codes

Joseph may generate one-use discount codes, including 50% off, custom-percentage discounts, or free-session codes. Discount codes apply only where supported in the app and are currently intended for Stripe-based Personal Clarity checkout. Discount codes have no cash value, cannot be sold, transferred for value, combined unless expressly allowed, or redeemed after use, expiration, deactivation, or misuse.

Discount codes do not apply to Apple in-app purchases unless Apple and the app specifically support that discount path.

7. Booking, Rescheduling, Cancellation, and No-Show Policy

Clients may reschedule eligible sessions until 2 hours before the scheduled start time through the app. Inside 2 hours of the scheduled start time, client self-rescheduling is not available and the $39.99 session may be forfeited under the reschedule policy.

Cancellations made at least 24 hours before the scheduled start may be eligible for a refund to the original payment method. Late cancellations, missed appointments, failure to attend, failure to provide accurate contact information, or failure to join on time are generally nonrefundable except where required by law.

Joseph may move, restore, cancel, or reschedule sessions from the owner dashboard for operational reasons, scheduling needs, technical problems, or other circumstances. Client-facing policy language should not be interpreted as a guarantee that every request will be accepted.

8. Google Meet Sessions

Google Meet is the supported video provider for live sessions. Confirmed sessions receive a Google Meet link in the app. You may access the link before the appointment to test it, but the official paid session begins at the scheduled time.

You are responsible for having a stable internet connection, working device, microphone, camera if you choose to use video, and a private environment. Do not share your meeting link with unauthorized people. Joseph may end or refuse a session if unauthorized people join, if a participant is disruptive, or if safety or privacy concerns arise.

9. Two-Person Resolution

For Two-Person Resolution, both people should be prepared to participate respectfully. The person who books may invite the other participant using the app's invite process. Both parties may not get the outcome they wanted. By using the Service, you acknowledge that Joseph may provide a direct recommendation based on what he believes is fair and practical after hearing the available information.

10. Recording Rules and Consent

Clients may not record sessions, copy audio, capture video, livestream, or distribute session content without written permission from Joseph and all involved participants.

Joseph may use an owner-only in-app audio reference recording only if all involved clients approve recording for that specific session inside the app during the meeting window. The recording is intended for internal reflection and decision preparation. Google Meet provider recording is not used in the current workflow. Recording consent may be denied; if all required participants do not approve, the owner audio reference should not be started.

11. Client Conduct

You agree to communicate respectfully, provide truthful information to the best of your ability, avoid harassment or threats, avoid illegal activity, avoid sharing another person's private information without permission, and comply with app instructions. Joseph may end a session, refuse service, restrict an account, or report safety concerns if conduct is abusive, threatening, unsafe, fraudulent, or inappropriate.

12. Written Resolution and Owner Notes

After a session, Joseph may submit a written resolution, reasoning, and action steps inside the app. Clients can view the client-facing resolution tied to their session. Private owner notes are for Joseph's internal use and are not client-facing.

The resolution is a practical recommendation, not a binding legal decision, therapeutic plan, diagnosis, or guarantee of relationship outcome.

13. Surveys, Ratings, and Public Excerpts

After Joseph posts a resolution and the session is over, clients may be asked to complete a survey. The survey may ask whether the session was helpful, whether the resolution felt fair, what could be improved, and an overall 1-to-5 rating. Survey answers are private by default.

If you allow a public excerpt, Joseph may choose a short portion of your feedback to feature publicly with your rating. Joseph may edit the excerpt for length, clarity, privacy, safety, or grammar without changing the meaning. You can contact luvmediation@gmail.com with concerns about a featured excerpt.

14. Support Inbox and Communications

The app may include a Contact Joseph inbox. Messages are for support, questions, and service-related communication. The inbox is not an emergency channel and should not be used for crisis situations. Joseph may review appointment status, account details, and message history to respond to support requests.

15. Privacy

Your use of the Service is also governed by the Luv Mediation Privacy Policy. The Privacy Policy explains what information is collected, how it is used, how it is shared, how long it may be retained, and how account deletion works.

16. Third-Party Services

The Service depends on third-party providers such as Firebase, Google Cloud, Google Meet, Stripe, Apple, App Store services, push notification providers, Firebase Hosting/Joseph S Apps website hosting, and other infrastructure or support services. We are not responsible for outages, rules, data practices, or failures of third-party services outside our control.

17. App Store and Apple In-App Purchase Terms

When you purchase Two-Person Resolution through Apple in-app purchase, Apple's terms and payment systems apply. Refund requests for Apple in-app purchases may need to be handled through Apple where required. Luv Mediation may not be able to directly reverse or discount every Apple transaction outside Apple's systems.

18. Intellectual Property

Luv Mediation names, branding, app design, copy, workflows, graphics, website content, and service materials are owned by Joseph Souffrant, Joseph S Apps, or their licensors. You may not copy, reproduce, resell, modify, reverse engineer, or use the Service materials for commercial purposes without permission.

19. No Guarantees

We do not guarantee that a relationship will improve, that both parties will agree, that a specific outcome will occur, that the other participant will attend, or that any recommendation will resolve the issue. Results depend on participant honesty, willingness, behavior, follow-through, and circumstances outside our control.

20. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or available at every time or location.

21. Limitation of Liability

To the maximum extent permitted by law, Luv Mediation, Joseph Souffrant, Joseph S Apps, service providers, and related parties will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, emotional distress, relationship outcomes, lost data, lost opportunities, service interruptions, or third-party actions arising from or related to the Service.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

22. Indemnification

You agree to defend, indemnify, and hold harmless Luv Mediation, Joseph Souffrant, Joseph S Apps, and related parties from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, violation of these Terms, violation of another person's rights, unsafe conduct, unauthorized recording, or illegal activity.

23. Account Suspension or Termination

We may suspend, restrict, or terminate access to the Service if we believe you violated these Terms, created risk, misused the Service, threatened someone, committed fraud, attempted unauthorized access, abused discounts, or created safety, legal, or operational concerns.

24. Governing Law

These Terms are governed by the laws of North Carolina, United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

25. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may notify you through the app, website, email, or another reasonable method, and may require renewed acceptance before continued use. The updated Terms are effective when posted unless a later effective date is stated.
